Today we bring you another successful case of Sterna Abogados that will help you to understand a little more how the different Spanish Consulates around the world work, how different they are from each other and the importance of having a broad knowledge in the field of Immigration to prepare our application according to the requirements of each Consulate.
Non-profit residency must be requested at the Spanish Consulate of the country of origin or residence. This implies that, in addition to being subject to Spanish regulations, we will also be subject to the regulations of the territory in which we are (since we will have to request the pertinent documentation and control the times) and to the internal operation of each Consulate.
It means that each Consulate will apply different criteria and a different procedure for the same residence permit (although that they will always be subject to some basic criteria established by the law).
A clear example is the availability of appointments at each Consulate. Some Consulates are extremely accessible and facilitate the process for individuals, but others are very complicated due to the difficulty in obtaining appointments and a general lack of information for citizens. Together we carried out the process successfully, allowing the client to start his life in Spain with the greatest possible peace of mind, receiving comprehensive advice and support.
Our case of success is a clear example of this last case. The application was submitted to the Consulate General of Spain in Los Angeles. We tried for months to get an appointment at this Consulate, already known for its difficulty in obtaining an appointment for any procedure related to immigration.
In the course of this process, after a long search and countless complaints to
the Consulate, our client’s documentation expired (remember that the documentation for this type of visa has a maximum validity, in general, of three months).
One of our complaints was successful and they opened appointments for citizens, so we were able to book our appointment. However, we were forced to reapply for the documentation to present it in force. Faced with this situation, our firm was outraged by the situation and by forcing our client to reapply for
documentation that expired due to the abnormal operation of the Consulate.
We prepared our client to provide the documentation that he already had together with a statement defending his rights against this unjust situation, to which the Consulate resolved the request favorably.
Currently our client is happily residing in Spain. He was able to start his life project with the tranquility and security of having a team that supports him and defends his interests.
