When Should You Renew Your Residence Card?
You can submit your renewal application:
- 60 days before the expiration date of your current permit.
- Up to 90 days after expiration.
If you apply after the card expires, you may face administrative penalties. However, this is not typically common. Delaying your renewal can risk your legal status, so we encourage you to start the process early.
Call us before it’s too late!!
The issue of renewal is not something we should worry about when the expiration of our card approaches, but something we must always keep in mind since to achieve renewal, we will be required to meet certain requirements that we must have fulfilled throughout our stay.
Requirements for Renewal Based on Your Residence Permit
Renewal for Residence and Work Authorization (Employment)
If your residence card is based on employment (work for others), you must prove that you have worked during the validity period of your permit. You need to meet at least one of these conditions:
- Ongoing Employment:
- You are still working under the same contract that initially granted your permit.
- Work Activity for at Least Six Months:
- You have a new employment contract and are registered with Social Security, or
- You have a job offer that guarantees employment upon approval of the renewal.
- Short-Term Work (Three Months):
- Your employment was interrupted for reasons beyond your control, and you can prove active job seeking (Public Employment Service registration).
- Special Circumstances:
- You have received unemployment benefits.
- You are a beneficiary of social assistance aimed at labor reintegration.
- You are a victim of gender-based violence.
- Your spouse or domestic partner has sufficient financial resources to support you.
In all cases, having clean criminal records and up-to-date tax payments will be considered.
Renewal for Self-Employment Authorization (Freelance Work)
To renew your self-employment residence permit, you must meet the following conditions:
- Legal Status:
- Not be a citizen of the European Union, the European Economic Area, or Switzerland.
- No criminal records in Spain or countries of prior residence.
- Ongoing Activity:
- Continue the same self-employed activity that granted your permit, with proof of compliance with tax and Social Security obligations.
- Family Financial Support:
- If your spouse or partner has sufficient financial means, they can support your renewal application.
- For two family members, the minimum required income is 150% of the IPREM. For each additional member, add 50% of the IPREM.
- Other Conditions:
- Proof of protection for cessation of activity, if applicable.
Renewal for Family Reunification Residence
If your residence permit is based on family reunification, you must prove that the family circumstances remain the same:
- For the Reunified Person:
- The family bond or partnership must still exist.
- If separated, an independent residence permit must be processed.
- For the Reunifier (Sponsor):
- Adequate housing must be maintained.
- Proof of sufficient income to support the family: at least 100% of the IPREM.
- Minor children in compulsory schooling age must be enrolled in school.
- Additional Requirements:
- No criminal records in Spain.
- Proof of paid processing fees.
- Valid health care coverage (Social Security or private health insurance).
These are the most common cases, if yours is not among them, call us to process it or in case you do not meet the requirements so that we can recommend what to do and manage all the procedures for you.
