Freelance residency permit – Spain. Can I work from home?
One of the hardest residency permits to achieve in Spain are the initial residency permits to work as freelancers.
Those initial types of permits are applied for from the consulate of Spain in the country of residency or of origin of the applicant and is subject to the issuance of a visa upon its’ approval.
However, this type of residency permit is the most often rejected due to the requirements that have to be meet upon the Administration’s interpretation of the law.
The requirements of the Administration are often very different of those stated by the law.
It was the case of our client who contacted us upon the denial of his residency permit because of mainly working from home. But we appealed and the judge ruled in our favor. The sentence issued by the judge rules that “the creation of jobs is merely a recommendation but it is not a mandatory requirement that might be imposed [as such]”.
