Permission for international workers: All the information
It has been a year since Law 28/2022, of December 21, on the promotion of the start-up ecosystem came into force, and since then we have had numerous approvals.
These grants have not exactly been easy, since it is a new permit that has been shaped by practice.
Among all these cases, one stands out in which it was especially difficult to demonstrate one of the requirements that emerged with practice: the last three bank certificates proving the receipt of the salary received through the company for which the applicant performs his profession.
In the case in question, our client was a psychologist and billed his private clients through a company he created himself.
Our client was a corporate self-employed, in which we had to demonstrate the triangular relationship: our client with his company and that company with the private clients to whom he billed.
Once the application was submitted, we received a request for additional documentation in order to correlate the invoices with the bank certificate submitted, and we had to write a letter in which we pointed out the clients one by one and what each of them had provided.
We also asked the bank to issue a certificate stating the amount paid by each person during the last three months.
After so much work, the Unit of Large Companies and Strategic Groups approved the request expressly of the holder, but with his relative, the spouse, we did not receive the concession within the legally established period for this purpose, which is twenty working days from the submission of the application.
When we did not receive that from the spouse so we presented the corresponding letter of concession by administrative silence and for that reason the difference in each one of the resolutions, in one it says “to grant” because the resolution was express on the part of the Administration, whereas that of the spouse says “to estimate by silence”, when not having resolved in the legally foreseen term.
